Part 1: Introduction and Agreement to Terms

1.1 Welcome and Service Introduction

Welcome to Beard Remover (referred to as "the Service" or "we")! We are dedicated to providing you with advanced image processing services based on artificial intelligence technology. Through our platform, you can upload photos containing human faces, and our service will automatically identify and remove beards from the photos, generating high-definition processed images. Our goal is to offer a simple, efficient, and creative tool to help you easily edit and enhance portraits.

1.2 Binding Agreement

These Terms of Service (hereinafter referred to as "these Terms") constitute a legally binding agreement between you and us regarding your access to and use of the Service. Please read and fully understand all clauses carefully, especially those concerning the exclusion or limitation of liability, applicable law, and dispute resolution.

By completing the registration process, accessing the website, uploading content, or using the Service in any way, you signify that you have fully read, understood, and unconditionally accepted all the provisions and conditions of these Terms. You confirm that you have the full legal right and capacity to enter into and perform these Terms.

If you do not agree with any part of these Terms, or if you cannot accurately understand their interpretation, please stop using the Service immediately. Your continued use will be deemed as your final acceptance of the entire content of these Terms.

1.3 Eligibility

This Service is primarily intended for adults. You hereby confirm and warrant that you are at least 18 years of age, or have reached the legal age of majority in your jurisdiction. If you are not of legal age, you must review these Terms with a parent or legal guardian and ensure that your parent or legal guardian agrees to your use of the Service and accepts to be bound by these Terms.

We do not knowingly collect personal information from minors. If you do not meet the age requirement, please do not register for or attempt to use the Service.

Part 2: User Accounts and Responsibilities

2.1 Account Registration

To fully use the features offered by the Service, you may need to register for a user account. You agree and promise that all information provided during the registration process (including but not limited to email address, username, etc.) is accurate, truthful, complete, and current. You are obligated to promptly update your registration information to ensure it remains accurate and valid.

We reserve the right to suspend or terminate your account if you provide untrue information or fail to update it in a timely manner.

2.2 Account Security

You are solely responsible for maintaining the confidentiality of your account, including but not limited to securing your password and restricting access to your computer or mobile device. You agree to accept full legal responsibility for all activities and actions that occur under your account, whether or not authorized by you.

If you discover or suspect any unauthorized use of your account or any other breach of security, you must notify us immediately. We will not be liable for any loss or damage arising from your failure to comply with this provision.

2.3 Basic User Responsibilities

You promise to strictly comply with all applicable local, state, national, and international laws, regulations, and ordinances, and to use the Service in a lawful and compliant manner. You shall not use the Service for any illegal purpose or for any purpose prohibited by these Terms. Your use of the Service must align with public interest, public morality, and the legitimate rights and interests of others.

Part 3: Acceptable Use and Content Policy

3.1 Core Principle Statement

This platform is committed to providing a safe, legal, and creative environment. We have a zero-tolerance policy for user-uploaded and generated content. You hereby explicitly acknowledge and agree that you are fully legally responsible for all "Input Content" (e.g., photos you upload) and "Output Content" (e.g., images with beards removed) generated using the Service through your account.

3.2 Strictly Prohibited Content Types

You hereby agree to never use the Service to upload, generate, store, or share any of the following types of content. Violation of any of the following provisions will be considered a serious breach of these Terms.

a) Pornographic and Sexually Suggestive Content:

This platform strictly prohibits the uploading or generation of any form of pornographic content. This includes, but is not limited to: depicting or suggesting sexual acts, nudity (especially with sexually provocative intent), child sexual abuse material (CSAM), and any information, images, or materials defined as obscene or pornographic under applicable law.

Special Statement: Any account attempting to upload, process, or generate content involving child or suspected child pornography will be immediately and unconditionally permanently banned, and we will proactively report all related data (including user information and content) to the relevant law enforcement agencies.

b) Violent, Gory, and Self-Harm Content:

This platform strictly prohibits the uploading or generation of any content that depicts extreme violence, gory scenes, terrorism, cruel abuse (of humans or animals), or encourages or glorifies self-harm/suicide.

c) Content Infringing on the Legal Rights of Others:

This platform strictly prohibits the uploading or generation of any content that infringes upon the legal rights of others, including but not limited to:

  • i. Infringement of Portrait/Image Rights: Without the explicit, prior written authorization of others, it is strictly forbidden to upload or use photos of others (including but not limited to public figures and private individuals) to generate images. It is particularly forbidden to use the Service to create Deepfake content, or for any purpose that may insult, defame, ridicule, or otherwise harm the reputation, image, and dignity of others.
  • ii. Infringement of Intellectual Property: It is strictly forbidden to upload images for which you do not hold the legal copyright or license (e.g., others' photographic works, artworks, copyrighted cartoon characters, trademarks, etc.) for generation or re-creation.
  • iii. Infringement of Privacy Rights: It is strictly forbidden to upload or generate content containing others' personally identifiable information (such as ID numbers, home addresses, phone numbers, email addresses, and other sensitive information).

d) Hate Speech and Discriminatory Content:

It is strictly forbidden to upload or generate any speech or images that advocate, promote, or constitute discrimination, harassment, hatred, or violence based on race, ethnicity, nationality, religious belief, gender, gender identity, sexual orientation, age, disability, or any other protected characteristic.

e) Illegal Activities and Fraudulent Content:

It is strictly forbidden to use the Service for any illegal purpose or to facilitate illegal activities. This includes, but is not limited to, creating counterfeit documents, forging identification, disseminating information proven to be false, phishing, fraud, and any other deceptive or misleading conduct.

3.3 Platform Rights

You acknowledge and agree that we have the right (but not the obligation) to review user-uploaded and generated content through technical means or manual review to determine whether it violates these Terms. For any content that we, in our sole discretion, deem to be in violation or potential violation of these Terms and relevant laws and regulations, we reserve the right to take one or more of the following measures at any time without prior notice to you:

  • Immediately remove or block the relevant content;
  • Issue a warning to you;
  • Suspend or restrict your access to some or all of the Service;
  • Permanently ban your account;
  • Preserve relevant records and report them to the competent authorities.

Part 4: Intellectual Property and Usage License Restrictions

4.1 Your Input Content

You retain all ownership and related intellectual property rights to any original "Input Content" (e.g., your personal photos) that you upload to the Service. We do not claim any ownership rights to your Input Content.

However, in order to operate and provide the Service, you hereby grant us a limited, non-exclusive, worldwide, royalty-free, sublicensable license. The sole and entire purpose of this license is to authorize us to host, store, copy, modify, process, and transmit your "Input Content" in order to provide you with the image generation service (i.e., processing Input Content according to your instructions to create "Output Content") and to improve our technical services. This license terminates when you delete the content or terminate your account.

4.2 Platform-Generated Output Content

a) License Grant:

Provided that you fully comply with all provisions of these Terms of Service, we grant you a limited, non-transferable, non-exclusive, revocable license to use the "Output Content" generated for you by the platform.

b) Usage Restrictions:

The scope of this license is strictly limited to "personal, non-commercial" use. The "Output Content" you generate is for your personal entertainment, study, research, or appreciation only. You may not use the "Output Content" for commercial purposes in any direct or indirect manner.

c) Explicit Prohibition of Commercial Uses:

To avoid any ambiguity, the following actions are explicitly and strictly prohibited:

  • Prohibition of Sale, Sublicense, or Distribution: You may not sell, license, rent, or otherwise distribute the "Output Content" itself to obtain direct financial gain.
  • Prohibition of Use on Physical or Virtual Goods: You may not use the "Output Content" for the production and sale of any merchandise (e.g., T-shirts, mugs, phone cases, posters, etc.).
  • Prohibition of Use in Advertising and Marketing: You may not use the "Output Content" in any form of advertising, marketing, brand promotion, or any other promotional materials.
  • Prohibition of Use for NFTs: You may not use the "Output Content" to create, issue, or trade any non-fungible tokens (NFTs) or other crypto assets.
  • Prohibition of Use as a Brand Identifier: You may not use the "Output Content" as, or as part of, a company logo, trademark, service mark, or any other brand identifier.
  • Prohibition of Use in Paid Media: You may not use the "Output Content" in any media, project, website, or application that requires users to pay for access.

4.3 Platform Intellectual Property

Except for the "Input Content" you own, the Service and all its related components, including but not limited to its underlying software, artificial intelligence models, algorithms, code, user interface, website design, text, graphics, trademarks, logos, service names, and all other materials and content (collectively, the "Platform Assets"), are the exclusive property of us and our licensors. All intellectual property rights related to the "Platform Assets" (including copyrights, trademark rights, patent rights, and trade secrets) are protected by law and are exclusively owned by us. You may not copy, modify, distribute, sell, or lease any of our "Platform Assets" without our prior written consent.

Part 5: Fees and Payment

5.1 Subscription and Credit Model

The Service uses a subscription-based payment model. You can purchase different subscription plans to obtain a corresponding number of "usage credits". Each successful image processing will consume one or more credits. The specific credit consumption standards will be clearly displayed on the service interface.

5.2 Pricing and Payment

The prices for all subscription plans will be clearly posted on our official website. We reserve the right to adjust prices at any time, but any price changes will be notified to you in advance via email or a website announcement before they take effect. Price changes will not affect the valid subscription period you have already purchased before the changes become effective.

You agree to complete payments through our designated third-party payment channels (such as Creem, etc.). You are required to provide valid and accurate payment information and authorize us or our payment processors to charge you according to the subscription plan you have selected.

5.3 Billing Cycle and Auto-Renewal

Subscription services are typically billed monthly or annually. To ensure service continuity, your subscription will automatically renew at the end of each billing cycle by default, unless you cancel auto-renewal through your account settings at least 24 hours before the end of the current subscription period.

5.4 Refund Policy

In general, all fees paid are non-refundable. This includes, but is not limited to, subscription fees you have purchased and unused credits. We do not provide refunds or credits for partially used service periods or unused credits.

In rare cases, such as if the service is completely unavailable for an extended period due to our technical failure, we may consider refund requests on a case-by-case basis at our discretion. All refund requests will be reviewed and decided by us on a case-by-case basis.

Part 6: Termination

6.1 Termination by User

You have the full autonomy to stop using the Service at any time. You can also request to delete your account at any time through your account settings page. Upon account deletion, all your personal data and user content will be permanently removed and cannot be recovered.

6.2 Termination by Platform

We place a high value on the security and compliance of the platform. Therefore, we reserve the right to unilaterally, immediately, and unconditionally suspend or permanently terminate your account without any liability or refund under the following circumstances:

  • You have seriously breached any provision of these Terms, especially but not limited to any prohibited actions listed in Part 3 (Acceptable Use and Content Policy) or Part 4 (Intellectual Property and Usage License Restrictions).
  • Your actions have caused or pose a potential threat of harm to the Service, other users, or third parties.
  • As required by laws, regulations, or government regulatory agencies.

After your account is terminated, you will lose access to your account, user content, and any purchased services or credits. All unused credits will be forfeited and will not be compensated or refunded in any form.

Part 7: Disclaimers and Limitation of Liability

7.1 Service "As Is"

You expressly understand and agree that the Service is provided on an "as is" and "as available" basis. We make no warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

  • (a) the Service will meet all your specific requirements;
  • (b) the Service will be uninterrupted, timely, secure, or error-free;
  • (c) the content generated through the Service ("Output Content") will be completely accurate, reliable, unique, or fully meet your expectations. AI-generated content may inherently have flaws and unpredictability.

7.2 User Responsibility and Assumption of Risk

You will assume all risks arising from the use of the Service and its generated "Output Content". You are solely responsible for ensuring that you have the necessary rights to the "Input Content" and are fully responsible for the manner and purpose of your use of the "Output Content". You agree that you will evaluate and bear all risks associated with the use of any content, including reliance on its accuracy, completeness, or usefulness. We are not responsible for any loss or damage resulting from your use of or reliance on any content.

7.3 Limitation of Liability

To the maximum extent permitted by applicable law, you expressly understand and agree that we and our affiliates, officers, employees, agents, partners, and licensors shall not be liable to you for any direct, indirect, incidental, special, consequential, or exemplary damages resulting from:

  • (a) the use or inability to use the Service;
  • (b) the cost of procurement of substitute goods and services resulting from any goods, data, information, or services purchased or obtained or messages received or transactions entered into through or from the Service;
  • (c) unauthorized access to or alteration of your transmissions or data;
  • (d) statements or conduct of any third party on the Service;
  • (e) any other matter relating to the Service.

This limitation of liability applies even if we have been advised of the possibility of such damages. In any event, our total aggregate liability to you shall not exceed the total amount you have paid to us for using the Service in the past six months.

Part 8: Indemnification

You agree to indemnify, defend, and hold harmless us, our affiliates, officers, directors, employees, and agents from and against any and all third-party claims, lawsuits, legal proceedings, demands, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • (a) Your access to or use of the Service;
  • (b) Any "User Content" you upload, process, or generate, especially any content alleged to infringe upon the intellectual property, portrait rights, or privacy rights of a third party;
  • (c) Your violation of any provision of these Terms, especially violations of Part 3 (Acceptable Use and Content Policy) and Part 4 (Intellectual Property and Usage License Restrictions);
  • (d) Your violation of any applicable law or regulation.

We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with us in defending such claims.

Part 9: Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If we make a material change to these Terms, we will notify you at least thirty (30) days before the changes take effect by sending a notice to the email address you provided at registration or by posting a prominent notice on our website. What constitutes a "material change" will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you must stop using the Service.

Part 10: Governing Law and Dispute Resolution

10.1 Governing Law

The formation, validity, interpretation, performance, and dispute resolution of these Terms shall be governed by the laws of the relevant region, without regard to its conflict of law provisions.

10.2 Dispute Resolution

We encourage you to contact us first to seek a friendly resolution in the event of a dispute. If the parties are unable to resolve the dispute through negotiation within thirty (30) days, any dispute, controversy, or claim arising out of or relating to these Terms shall be submitted to the court for resolution through litigation.

Part 11: Miscellaneous

11.1 Entire Agreement

These Terms constitute the entire agreement between you and us regarding the Service and supersede and extinguish all prior or contemporaneous understandings, agreements, representations, and warranties, both written and oral.

11.2 Severability

If any provision of these Terms is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable, such provision shall be deemed severed from these Terms, and the remaining provisions shall remain in full force and effect.

11.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative of ours.

11.4 Assignment

You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. Any attempt by you to assign or transfer these Terms, without such consent, will be null and void. We may freely assign or transfer these Terms without restriction. Subject to the foregoing, these Terms will bind and inure to the benefit of the parties, their successors, and permitted assigns.

11.5 Headings

The headings in these Terms are for reference only and do not affect the interpretation of these Terms.
